Clinton requested Senator Fulbright and others to help him get into the ROTC unit at the University of Arkansas. That ROTC unit was already filled to capacity and there was a waiting line. With the assistance of Sen. Fulbright's office, a series of lies to Col. Holmes at the University of Arkansas ROTC unit (see Clinton's views on the military), he was able to get his draft notice suspended pending enrollment into ROTC, which of course he never did. During the process of accomplishing the above, Bill Clinton violated several laws and regulations. ------------------------------------------------------------------------------ -- Laws Clinton Broke By His Sham Enrollment in ROTC Section 50 USCS Appx-465"... no person shall be accepted for (ROTC) enlistment after he has been issued an order to report for induction, unless authorized by the director and the Secretary of Defense..." No authorization was received or granted. His ROTC Acceptance Was Fraudelently Negotiated!! This means that the removal of Clinton's name from the 1-A listing because of his enrollment in ROTC, did not release him from his primary legal obligation to report for duty as per the draft notice he received earlier. The enrollment was illegal. By failing to report for induction on July 28, Clinton broke10 USCS=801, N543"Where person had registered for draft, was delinquent, and was mailed notice to report before certain date or he would be in military service of United States, he was subject to trial by court-martial after that date, and it was not necessary to show his receipt of notice ..." He Wasn't A Student At The Time!! Clinton was not officially enrolled as a student at the school where he enrolled in ROTC, therefore he vas in violation ofSection 32 CFR CH V"(c)Students desiring enrollment in a unit must: (1) be enrolled in and attending full time a regular course of instruction at a school participating in the program." Note here that this ROTC enlistment was accomplished by illegally withholding the fact he had already been drafted and by unlawfully withholding the fact that he had two years ROTC experience at Georgetown University. By rejoining ROTC, he had automatically committed himself to a mandatory two years of active duty in the army. He had refused to sign up for the third year of ROTC earlier for this very reason. Section 10 USCS=2105: A member of the program who is selected for advanced training (third and fourth year ROTC) ... and who does not complete the course of instruction...may be ordered to active duty by the Secretary of the military department concerned to serve in his enlisted grade or rating for such period of time as the Secretary prescribes but not for more than two years. Clinton did not follow this part of the law. He should have been prosecuted in federal court or at a court-martial when he submitted his informal resignation in a letter in December 1969- the day after the new draft lottery went into effect. Section 50 USCS=562.28Enrollment. Says once a student has signed up for the third or fourth year of ROTC, that student must "...complete that course as a requirement for his graduation, unless relieved of this requirement by regulations prescribed by the Secretary of the Army." Clinton didn't obtain it. He just quit. ------------------------------------------------------------------------------ -- Additional Laws Clinton Broke 10USCS=883, Fraudulent enlistment, appointment, or separation Any person who ... procures his own separation from the armed forces by knowingly false representation or deliberate concealment as to eligibility for that separation, shall be punished as a court-martial may direct. 32 CFR=1632.14.Duty of registrant to report for and submit to induction. 32 CFR=1621.16.Permit to depart from the US. Clinton failed to submit SSS Form 300, Permit for Registrant (of Selective Service) to Depart from the United States. So his draft board was not officially aware of where he was out of the country and learned of it by word of mouth. 32 CFR=1641.3.Communications by mail. Because of the above, Clinton had not officially informed the selective service board of his change of address and therefore was unable to receive mail directly from that board. 10 USCS= Art.86.Absence without leave. Due to both of above, he was AWOL. 10 USCS=Art. 104.Aiding the enemy. By leading anti-Vietnam rallies in England while the US was at war with that nation, Clinton "without proper authority, knowingly harbors or protects or gives intelligence to, or communicates or corresponds with or holds any intercourse with the enemy, either directly or indirectly. By law, he shall "suffer death or other such punishment as a court-martial or military commission may direct. Same law applied to his 1969-70 trip to Moscow and Prague where he was with a founder of Czechoslovakia's Communist Party which could be considered an "attempt to aid the enemy with arms, ammunition, supplies or other things." 10 USCS= 894. Art. 94.Mutiny or sedition. Re: failure to report for duty, ROTC cadet therefore army reservist, Clinton "refuses...to obey orders or otherwise do his duty...is guilty of mutiny, (which) shall be punished by death or other such punishment as a court-martial may direct. 18 USCS=2383.Rebellion or insurrection. By leading two anti-Vietnam rallies in England and taking part in a rally in Moscow, Clinton was subject to this law as someone who "incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or laws thereof, (or) gives aid or comfort thereto (and) shall be fined not more than $10,000 or imprisoned not more than ten years, or both and shall be incapable of holding any office under the United States." 32 CFR=562.29a.Discharge or disenrollment. Clinton had signed DA Fpr.597, an advanced course students' contract to enlist in ROTC at U of A. If he had filled out the application honestly, he would have cited his prior ROTC experience. This would have made his commitment to ROTC at U of A irrevocable. 10USCS=932.Art.132.Frauds against the United States Clinton received reimbursement for travel in connection with his trips to U of A to enroll in ROTC. Because he knew statements made in form DA Fpr. 597 were false, the penalty is whatever term imposed by a court-martial. 10USCS=885.Art.85 Desertion"...any member of the armed forces who (1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently; (2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service...is guilty of desertion...or attempt to desert (and this crime) shall be punished, if the offense is committed in time of war, by death or such other punishment as court-martial may direct. 18USCS=2388, Activities affecting armed forces during war Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies shall be fined not more than $10,000 or imprisoned not more than twenty years, or both. Treason Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined not less than $10,000; and shall be incapable of holding any office under the United States. (peace rally in Soviet Union, visit with chairman of Communist Party in Czechoslovakia) 18USCS=2387.Treason, Sedition Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States: (1) advises, consoles, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military shall be fined not more than $10,000 or imprisoned not more than ten years, or both , and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction. (Clinton admitted in his letter to Col. Holmes that he wrote a letter to the draft board for another American student at Oxford, who was a fugitive because he refused induction.) 18USCS=884.Art.84.Unlawful enlistment, appointment, or separation Any person subject to this chapter who effects an enlistment or appointment in or a separation from the armed forces of any person who is known to him to be ineligible for that enlistment, appointment, or separation because it is prohibited by law, regulation or order shall be punished as a court-martial may direct. -- Applies to Col. Holmes and Jones as they got Clinton into the ROTC when he was ineligible and by Holmes for accepting Clinton's informal resignation. Clinton faced the same penalties because of his role in the conspiracy. Section 128... if a registrant or a person required to present himself for and submit to registration fails to perform any duty prescribed by the selective service law, or directions given pursuant thereto, within the required time, he shall...upon conviction in any district court of the United States of competent jurisdiction, be punished by imprisonment for not more than five years or a fine of not more than $10,000, or by both such fine and imprisonment, or if subject to military or naval law may be tried by court-martial, and, on conviction, shall suffer such punishment as a court-martial direct. 10USCS=843.Art.43.Statute of limitations (a)A person charged with desertion or absence without leave in time of war, or with aiding the enemy, mutiny, or murder, may be tried and punished at any time without limitation. And this same Bill Clinton who broke all those laws to stay out of military service was known for leading anti-war demonstrations -- until after he received a draft number that kept him out of the draft. Even though the fighting in Vietnam continued, Billy stopped being a war protester.
