DENISE'S DEAL BLOCKED BY FEDS

Manhattan U.S. Attorney Mary Jo White yesterday launched a probe
of whether fugitive billionaire Marc Rich bought his pardon -
blocking an immunity deal to let his ex-wife, Denise, tell all.

Sources said White wants to probe financial records to see if
there's any evidence that Marc Rich, hiding from a 51-count
indictment in Switzerland for the last 18 years, wired money to
Denise Rich in New York while she lobbied Bill Clinton for the
pardon.

The Justice Department told congressional investigators yesterday
to halt their plan to give Denise Rich criminal immunity to
compel her to testify publicly about the pardon that has sparked
a furor.

"This, certainly, is acceptable," said House Government Reform
Chairman Dan Burton (R-Ind.), adding that his investigators "will
make every effort to refrain from taking any action that may be
harmful to the interests of law enforcement."

The Post this week reported that White, a Clinton appointee who
has denounced the Rich pardon, will be asked to stay on the job
for at least three more months by Bush's team.

Denise Rich, who gave more than $1 million in campaign
contributions to the Democrats and $450,000 to the Clinton
library, has so far refused to answer questions about her
ex-husband's pardon, citing her right to avoid incriminating
herself.

White is expected to subpoena Denise Rich's bank records, as well
as the records of her contributions to the library, the Clinton
legal fund and Democratic campaigns. White is expected to decide
in about a week whether to open a full-blown criminal
investigation, sources said.

Such an investigation could focus on whether Bill Clinton took a
bribe in exchange for the pardon, whether Marc Rich illegally
funneled campaign money through a conduit, whether he tried to
bribe the president through a conduit (his ex-wife) and whether
Denise Rich was involved in a conspiracy to bribe a president.

Such a criminal probe would make it unlikely that Denise Rich
would get criminal immunity from Congress for her testimony -
since immunity would make it very difficult for federal
prosecutors to make a conviction stick.

Clinton's last-day pardon of Rich has outraged many Americans
because Rich hid overseas and even tried renouncing his
citizenship after he was indicted in 1983 for evading $48 million
in taxes and trading with the enemy, Iran, during the hostage
crisis.

U.S. Pardon Attorney Roger Adams, a career staffer, told the
Senate Judiciary Committee yesterday that the White House didn't
tell him about Rich's full record, including his fugitive status,
as it pushed a pardon past the Justice Department just hours
before Clinton left office.

Adams said a White House lawyer told him there was "little
information" on Rich and his business partner, Pinky Green, and
that "they had been living abroad for several years."

Adams sounded frustrated but said there was little he could do.

"If the president decides not to follow procedure, which is any
president's right, if he doesn't want any input from the Justice
Department, if he doesn't want an investigation from my office, I
can't force one down his throat," Adams said.

Sen. Charles Schumer (D-N.Y.) said the Justice Department should
investigate if there are criminal allegations.

"The president may have unbounded power to grant the pardon, but
that doesn't mean that those seeking pardons can do anything they
want to get one," Schumer said in the latest sign of Democratic
concern over the pardon.

Documents show Clinton took a personal interest in the Rich
pardon as it was being pushed by ex-White House counsel Jack
Quinn, who was Rich's high-priced lawyer, and fund-raiser Beth
Dozoretz.

Clinton called Dozoretz to discuss the pardon on Jan. 10 while
Dozoretz and Denise Rich were in Aspen together - and e-mails
turned up by House investigators showed that Clinton told
Dozoretz he was prepped to pardon Rich but still needed to
convince the White House lawyers.

House investigators have subpoenaed records of the Clinton
library to see if contributions are linked to pardons, but
Clinton's lawyer David Kendall says he plans to fight the
subpoena in an effort to keep the contributions a secret.
