Peter Michael Liddy was facing the Supreme Court on the first day of his trial. The 57-year-old, of Kapunda, has pleaded not guilty to eight counts of indecent assault, six counts of unlawful sexual intercourse with a person under 12, one count of procuring an act of gross indecency and one of offering a benefit to a witness. All but one of the offences are alleged to have occurred between 1983 and 1986 while Mr Liddy was a magistrate. He retired in 1999, after 25 years in the judiciary. The last count allegedly occurred on June 11, 1999, and relates to the payment of a sum of $5000 to one complainant as an inducement to withhold or give false evidence. The court was told that on one occasion Mr Liddy locked a young boy in a courthouse cell and refused to let him out until he performed oral sex on him. Although the boy was in tears, Mr Liddy turned him around, put his head over a sink, and then raped him, the court was told. Opening Mr Liddy's trial, Trish Kelly, prosecuting, said each of his five alleged victims had been abused in courthouses in which the former magistrate presided. One boy was sexually assaulted in Mr Liddy's chambers in the Glenelg Courthouse after he had watched Mr Liddy complete a case, Ms Kelly said. The court heard Mr Liddy met the boys through his positions as a coach at the Brighton Surf Life Saving Club and a state junior life-saving coach. Each of the alleged victims was a "nipper" – junior lifesavers aged from seven to 13. Some of the boys joined the Brighton SLSC after Mr Liddy gave presentations to their schools, Ms Kelly said. "The prosecution says that Mr Liddy used and abused his position, both as a magistrate and an official of the Brighton SLSC, first of all to gain the friendship and trust of these young boys and the parents of these boys . . ." she said. Ms Kelly said this enabled Mr Liddy to spend large amounts of time with the boys "alone and in company sometimes, and eventually overnight, on overnight trips". Ms Kelly said the five alleged victims were part "of a smaller group that the accused chose to take away on day trips and sometimes the whole of the weekend". Mr Liddy regularly drove through Adelaide in his van to pick up the boys before surf life-saving carnivals, the court heard. He even had written to some parents – on paper with court letterheads, signed Peter Liddy, magistrate – asking for their permission to take their children to and from training. "You will hear evidence the boys who were closest to the accused would regularly sit in the front of the van, next to the accused, and sexual activity would often take place on the way to the beach," Ms Kelly said. The boys were introduced to sexual conversations and games, which they played at locations such as "cock rock", near Maslins Beach. "Some of this horseplay (was) quite normal and natural for young boys but . . . there are other aspects of that behaviour which the prosecution says was encouraged and condoned and, in some cases, joined in with by the accused for the very purpose of introducing the complainants to the kind of sexual activity with which he is now charged," Ms Kelly said. As well as the Glenelg and Victor Harbor courthouses, the offences allegedly occurred in the showers at the Brighton SLSC, a Victor Harbor hotel, a swimming hole and an island off Port Elliot. Ms Kelly said Mr Liddy had formed a "particularly close relationship" with the alleged victim relating to the bribe charge. He had told him "I'm going to leave you everything". During a visit to the Victor Harbor hotel, Mr Liddy allegedly took explicit photos of himself and the boy. Mr Liddy described him to hotel staff as his son, the court heard. In a brief defence opening, Marie Shaw, QC, for Mr Liddy, said the jury may find the allegations "downright shocking" but urged them to keep an open mind while the evidence unfolded.
