IRA's mockery of justice

06may01

THE human rights of IRA terrorists shot dead in an SAS ambush as they tried
to blow up a police station and murder the officers inside were violated, a
European court ruled yesterday.

In a decision condemned as "astonishing and perverse", seven judges said
Britain should pay the families of the eight men - among them some of the
IRA's most notorious killers - $30,000 each because the cases were not
properly investigated.
The European Court of Human Rights also made similar awards to the families
of two other IRA men and a Sinn Fein member killed in separate incidents.

British taxpayers face a total bill from the action of $670,000 including
legal costs.

There were fears the ruling could lead to further compensation claims from
relatives of terrorists killed by security forces.

The judges, including one Briton and an Albanian who spent his early years
tracking down opponents of the former communist regime, did not rule that the
deaths were unlawful. Their unanimous ruling related to procedural matters.

It was greeted with jubilation by the families and with outrage by Unionists
and the Royal Ulster Constabulary.

David Trimble, Ulster Unionist leader and First Minister at the Northern
Ireland Executive, said the judgment was "astonishing and perverse".

"There would be people who would call into question the competence and the
judgment of the European Court," he said.

A spokesman for the Police Federation, which represents RUC officers, said:
"If IRA members are killed in action carrying out a murderous deed, they will
be rewarded with a lump sum or pension. There really is no justice."

Asked if the government would pay compensation, a spokesman for Prime
Minister Tony Blair, said: "That is something that will have to be looked at."

The IRA unit, known as the "A Team", was ambushed by the SAS as it attacked
Loughgall police station in County Armagh in May 1987. The gang exploded a
large bomb which killed two RUC officers.

As the gang jumped from its van intending to shoot dead any survivors, the
SAS opened fire, killing all eight and a motorist caught in the crossfire.

Weapons recovered at the scene were later linked to eight murders.

An 11-week-old baby girl was hurt by flying glass when a bomb was thrown at a
police station in Belfast, Northern Ireland, yesterday. Her injuries were not
thought to be life-threatening.
