NEW YORK, June 12 -  A terrorist convicted in the 1998 bombing
of the U.S. embassy in Kenya received life in prison Tuesday
after a jury deadlocked on sentencing him to death for the
deadly attack. The anonymous jury deliberated for five days
over the fate of Mohamed Rashed Daoud Al-'Owhali, 24.
 Al-'Owhali is among four men convicted of conspiring with
exiled Saudi dissident Osama bin Laden to murder Americans.

         AL'OWHALI, of Saudi Arabia, rode in the truck used in
the Aug. 7, 1998, bombing of the U.S. Embassy in Nairobi,
Kenya, before leaping out and hurling stun grenades at guards.
       He then ran for his life as the bomb-hauling truck
exploded outside the embassy, killing 213 people and injuring
thousands more. Eleven people were killed in a simultaneous
bombing of the U.S. mission in Dar es Salaam, Tanzania.
       Al-'Owhali is among four men convicted of conspiring
with exiled Saudi dissident Osama bin Laden to kill Americans.
       The penalty trial for Al'Owhali will be followed by an
identical hearing for co-defendant Khalfan Khamis Mohamed, 27,
of Tanzania, who helped prepare the bomb used in Tanzania.


  Embassy Bombs Verdict
             Wadih El-Hage, 40, of Arlington, Texas, and
Mohamed Sadeek Odeh, 36, of Jordan, convicted of conspiracy by
the same jury, also face life in prison when they are
sentenced.
       The case against al-'Owhali marks the first time the
U.S. government has sought the death penalty for terrorism
committed against Americans in a foreign country.

JURORS' NOTE
       On Monday, the Manhattan federal jury had sent a note
to U.S. District Judge Leonard Sand indicating it might be
unable to reach a unanimous decision on the death penalty.
Because of the note, lawyers in the case had expected the jury
to announce on Tuesday morning that it was deadlocked.

         Sand told the jurors that if they were satisfied that
they could not reach an agreement on the death penalty, they
should write the following on the verdict form:
       "We the jury do not unanimously find that the death
sentence is appropriate. We understand that the consequence of
this is that al-'Owhali will be sentenced to life imprisonment
without the possibility of release.

MOST-WANTED FUGITIVE
       Bin Laden, indicted as the mastermind behind the
bombings, is one of America's most wanted fugitives and one of
13 men still wanted in the case. He is believed to be in
Afghanistan, and the U.S. government has offered a $5 million
reward for information leading to his arrest.
