Bob's Note:   What a laugh is right !!!!!  This was put before the 104th
Congress, 1st Session, again by Mr. Shadegg as H.R. 2270 (6 Sept 1995) and
was "referred to committee" and "RE-referred to another committee" and so on.
 Each committee chair REFUSED to even look at it and REFUSED to send it back
to the floor.  Apparently they knew that if they had to specify the
Constitutional authority for the unconstitutional garbage they pass into law,
they would be out of business-as-usual and could not peddle their
wares-of-influence to the highest bidder.

How could they blatantly turn their collective backs on their oath "to
support and defend the Constitution of the United States of America".....?
Simple!!

They knew that the dumb-ass sheeple that used to be "We The People" and have
since lost their courage, intelligence, wit, and have befallen to the Public
Fool System, would do ABSOLUTELY NOTHING.  Apparently the scumbags on
Capital(sic) Hill were right in their assumption concerning the lethargic
sheeple.

May God have mercy on what will remain of my once-great nation, this I pray.

Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,


SECTION 1. SHORT TITLE.

This Act may be cited as the `Enumerated Powers Act'.


SEC. 2. SPECIFICATION OF CONSTITUTIONAL AUTHORITY FOR ENACTMENT OF LAW.


(a) CONSTITUTIONAL AUTHORITY FOR THIS ACT- This Act is enacted pursuant to
the power granted Congress under article I, section 8, clause 18, of the
United States Constitution and the power granted to each House of Congress
under article I, section 5, clause 2, of the United States Constitution.


(b) CONSTITUTIONAL AUTHORITY STATEMENT REQUIRED- Chapter 2 of title 1,
United States Code, is amended by inserting after section 102 the following
new section:


`Sec. 102a. Constitutional authority clause


`Each Act of Congress shall contain a concise and definite statement of the
constitutional authority relied upon for the enactment of each portion of
that Act. The failure to comply with this section shall give rise to a
point of order in either House of Congress. The availability of this point
of order does not affect any other available relief.'


(c) CLERICAL AMENDMENT- The table of sections at the beginning of chapter 2
of title 1, United States Code, is amended by inserting after the item
relating to section 102 the following new item:


`102a. Constitutional authority clause.'.

"This act (or resolution) is enacted pursuant to the power(s) granted to the
Congress
under Article(s)                section(s)             , clause(s)
    of the United States
Constitution.' ".

 "(b) A similar clause shall precede the first title, section, subsection or
paragraph, and
each following title, section, subsection or paragraph to the extent the
later title, section,
subsection or paragraph relies on a different article, section, or clause of
the Constitution
from the one pursuant to which the first title, section, subsection or
paragraph is
enacted.".

 (c) TECHNICAL and Conforming Amendment.---The table of sections for chapter
2 of title
1, United States Code, is amended by inserting after the item relating to
section 102 the
following:

  "102a. Constitutional authority clause.".
