Rats in the Grain
The Dirty Tricks and Trials of Archer Daniels Midland
The "Supermarket to the World"
Agribusiness titans stealing money from their own customers—farmers, grain
brokers, smaller manufacturers. High-level executives with ties to
international businesses and governments joking about the client as the
enemy, as they globally fix prices and violate both the spirit and the letter
of antitrust laws. This was a day in the life of Archer Daniels Midland, the
self-appointed "Supermarket to the World." Rats in the Grain exposes the
everyday skulduggery that became the subject of a massive FBI investigation,
complete with wiretaps, hidden cameras, and a volatile corporate informant.
ADM had a checkered past full of scandal and conspiracy charges, but it
enjoyed the protection of powerful politicians from both parties thanks to
the charming and canny chairman Dwayne Andreas. From unscrupulous Cold War
grain deals to Watergate pay-off money, nothing seemed to stick to the
Midwestern power broker. But in the summer of 1995, that luck changed. After
an intense undercover operation, the FBI pounced. In a highly coordinated
raid, agents swept through offices and homes of the key executives, including
the Andreas scion and golden boy Michael, Terry Wilson, vice president, and
the mole himself, Mark Whitacre. Hours of tapes had been made by Whitacre of
these principals colluding with their competitors from Japan, Korea, and
Europe. They'd been caught red-handed.
These surveillance tapes were damning. In language more suited to a sop
histicated crime syndicate than a Fortune 50 company and its top executives,
the conspirators divided world markets, inflated prices, and carefully
planned the cover-up. Rats in the Grain contains the stop-action photos from
the FBI files to accompany the text and testimony.
After countless delays, the federal case came to trial in Chicago in the
summer of 1998. Like a legal thriller, Rats in the Grain profiles the
witnesses and their testimony, the phalanx of ADM lawyers and the federal
prosecutors, inner workings of the Departments of Justice and Antitrust, the
judge, and the always unpredictable mole. Lieber developed a close
relationship with Whitacre, visiting him in prison, and trying to understand
what drove the super-achiever to turn on the hand that fed him.
James B. Lieber uses both his investigative journalist skills and his
experience as a practicing attorney and seasoned litigator. He deftly threads
through the legalese and arcane court procedure, the cross examinations and
the redirects, the negotiations and the surprises, to reveal the dark
practices of ADM and its unblinking refusal to accept responsibility. In
addition to the narrative, Lieber charts the story with a time line,
appendices, and a thorough and comprehensive cast of characters. Rats in the
Grain is an informed and accessible parsing of an extraordinarily complex
legal case. Lieber brings to light a disturbing portrait of fraud,
conspiracy, and corruption in America's heartland.
James B. Lieber is the author of Friendly Takeover: How an Employee Buyout
Saved a Steel Town (Viking, 1995). He has written articles on social and
political issues for The Atlantic, The Nation, The New York Times Magazine,
The Village Voice, The Saturday Evening Post, and Mother Jones, among others.
He lives and practices law in Pittsburgh, PA.
