Sharon escapes trial for war crimes against refugees By Rory Watson AN appeal court in Brussels threw out an attempt yesterday to have Ariel Sharon put on trial in Belgium for alleged war crimes committed against Palestinian refugees 20 years ago. The ruling was based on Belgium's criminal code, which states that alleged crimes committed outside the country can be pursued only when the suspect is in Belgium. The case was brought by 23 Palestinians who survived the 1982 massacre by Israeli-backed Christian militias in the Shabra and Chatilla refugee camps near Beirut. The survivors have appealed to Belgium's Supreme Court. The judgment is a setback to human rights lawyers who were relying on a 1993 Belgian law giving courts universal jurisdiction to initiate trials for genocide and war crimes, irrespective of where the alleged offences were committed or the nationality of those involved. Other Belgian investigations into alleged crimes against humanity may be halted. The court did not say if Mr Sharon would have immunity if he went to Belgium as Israeli Prime Minister.
