While I agree with you, your statement and question do not answer my  
question about where the GPL clearly states it is building upon  
copyright law.  If the GPL does, great, show me where?  If the GPL  
doesn't then we can't say it does.  As far as I can tell the GPL is  
just another license with some interesting features.  But then the  
recent Sony EULA also has some interesting features.  ;)

In the example, John Doe has provided the source code.  As far as I  
can tell he is abiding by the GPL.

Again, the original questions were:

1) Has John Doe violated copyright law?  If so, what section?
2) Has John Doe violated the GPL?  If so, what section?
