* subscribe at http://techPolice.com City Net user accused of pursuing sex with 13-year-old girl Motel `tryst' ends in arrest FORT WAYNE - THE JOURNAL GAZETTE Thursday, March 22, 2001 Karen Balsley The Journal Gazette When Jonathan Garza entered a Fort Wayne motel room last week, he expected to find a 13-year-old girl -- whom he'd arranged to meet via the Internet -- waiting for him in a white teddy, court records say. Instead, he was greeted by officers who arrested him on a charge of attempted child solicitation. Garza, 23, of the 200 block of Fleming Avenue, was formally charged with the felony crime Wednesday and was being held at the City-County Lockup in lieu of $10,000 bail. Indiana State Police and federal agents had tracked Garza for three months after a constable in New Zealand found an Internet message from a man seeking child pornography, a probable cause affidavit filed in Allen Superior Court on Wednesday said. The New Zealand official reported his discovery to the National Center for Missing and Exploited Children, who in turn passed the information along to U.S. Customs officials, the document said. Investigators reported they located numerous messages dating back to late December from a man seeking videos and articles about underage girls in sex acts.On Jan. 11, the same man allegedly posted a message on an Internet newsgroup requesting information on initiating a sexual relationship with a young girl, the affidavit said. In mid-February, U.S. Customs Special Agent Tom Rothrock began surveillance on Garza's home after officials identified him as the person posting the messages. A few days later, Rothrock posted a message on the newsgroup implying he had similar interests as Garza, the affidavit said. Ongoing discussions ensued, during which Garza asked to be introduced to an underage girl. Garza also sent the agent numerous pornographic videos featuring girls younger than 18, the affidavit said. In early March, Garza told Rothrock he would pay to have sex with a teen-age virgin and asked him to bring such a girl to a hotel in Fort Wayne, court records said. Rothrock led Garza to believe he would arrange an introduction with a 13-year-old girl named "Stacey," the affidavit said. Garza requested Stacey wear a school uniform with a white teddy underneath, the affidavit said. On March 14, investigators had a confidential informant call Garza under the pretense that she was a 13-year-old girl named Stacey. During the recorded conversation, Garza made several lewd comments about what he wanted to do with her, court records said. The next day, Rothrock met Garza and drove him to a motel on Fort Wayne's southwest side. He was arrested about 10:30 p.m.In Indiana, child solicitation is a Class D felony punishable by 1 1/2 to three years in prison. However, the offense is a Class C felony if committed by using a computer network, meaning a defendant faces up to eight years in prison if convicted. Garza is to appear in court Friday.
