The "powers that be" in the USA no longer consider such silliness as
constitutionality. We have a sitting president who long ago put to rest
the notion that there was a barrier between the Executive and Legislative
branches of government. The country has gone along with it. Coupled with
the horrific violations of the past, it's pretty fair to say we are ruled 
by the
cult of personality and polls, not by law. 

The USA is no longer so much a constitutional republic, but is rather a
government of federal socialism as envisioned by Hitler. This was outlined
in detail during the sitting presidents State of the Union address last 
year, where
he called for a "third way" of continued economic growth through the close 
cooperation
of corporate business and government. 

If the government wants such a law, the government will get it. Most of 
the people
will support it for the good of the children. Thats how things are here 
in the USA.
