was tried when they first came out!

Like I said someone had to buy the cd and if companies take back open cd's well thats 
the companies fault....computer software can't be returned after it's been 
opened...why not music cd's

 ....No one is selling the mp3's...it's a free service.

-So is my copying music CD's using computer equipment -(meaning that those
-CD's don't pay the licensing fee) however that doesn't -change the fact
that it is theft. If my friend buys a book and I copy it using a copy
machine onto yellow paper or overhead projector film doesn't effect the
fact that I am in possession of a unlicensed copy.

The fact that it's on mp3 isn't really the issue, the issue is that all
those people who like Metallica music but don't want to pay for it are now
getting their comeupance. Trying to cast Metallica as the baddie in this
is a disservice to all music lovers (especialy those of us who have worked
with bands and understand how hard it is to make a living if everyone is
stealing your material).

You even said that most of the revenue is from stuff other than the music...and it's 
not the fans that are mad it's metallica because no one wants their music anymore and 
they can't figure out why...so instead of looking at the music...they found someone to 
blame...Napster



 As far as trying before you buy, that's why the radio station

most of the songs good songs they don't even play on the radio...and if they did play 
an entire album on the radio and I recorded it...under your logic I could THEN use it 
on napster because the radio payed the fee's right?

-So, the next question is, do most mp3 users record off the -air? No, they
-don't. They either buy a CD and then return it for -exchange (notice the
-nice infinite loop there) or else borrow CD's from other -people.

so recording off the radio isn't borrowing, right. and it's not my fault record stores 
let you bring back cd's that are open




I'd bet that if you got to display your art (it might help if you'd get
off your lazy ass and instead of stealing other peoples work actualy go
out and hit the occasional gallery...Then you'd find out what 'luck' is.

well actually smart-ass since I work all day I'm not on my ASS all day and I have been 
to galleries and have many contacts in the art world....it's still hard as hell to get 
a show...prick




The reality is that even top draw bands make their money on ancillaries
like t-shirts and memorabilia

so why wine about the music? if most of the money comes from other stuff?




Oh, that album you sampled and listen to probably dozens of times but
never bought represents the bands paycheck. How do you feel when you work
a week and then find out somebody is going to reduce your pay because of
theft? Probably not the happiest camper in the woods I suspect.

well no if I found out someone was giving away my art...but I was still making most of 
my money from other things...I would be thrilled that I could touch more people than 
just the ones who can buy my stuff....


I can say you've never stepped one foot into a sound studio or been
involved in any sort of album production.

actually yes I have and it was work but not the same kind of work that I am talking 
about...real work...draining work...painfull work...the kind of work where you dread 
going in everyday but if you don't you lose your job....that is the kinda work I 
amtalking about old man.
