Court of Appeal quashes death sentence against 2


2 people, who were sentenced to death for robbery, have been acquitted by
the Court of Appeal.

Hillary Nsambu reports that in 2000, the then Jinja High Court resident
Judge, Faith Mwondha, sentenced to death Kassim Isiko and Madina Nagudi
for aggravated robbery.

However, the appeal court last week ruled that the evidence that was
submitted against the 2 was not sufficient to warrant their conviction.

The appeal was heard by justices George Engwau, Amos Twinomujuni and
Stephen Kavuma.

But the justices upheld the death sentence against the duo's co-accused,
Yahaya Lukwago, saying the victims of the robbery had identified him
during a suspects' parade.

"It seems to us that the sole reason why Isiko and Nagudi were convicted
was that they were found in Mbale town in Nagudi's restaurant where
Lukwago was arrested," the court argued.
