TEXAS:
Let execution proceed:
Re: "Woman set to die is given reprieve -- Judge allows 60 days for appeal that
would focus on possible discrimination in jury selection," Jan. 30 news story.
On Jan. 29, Kimberly McCarthy was scheduled to be executed by the state of
Texas for the murder of Dorothy Booth. McCarthy murdered 2 other elderly and
defenseless women, Jettie Lucas and Maggie Harding. The family and loved ones
have been waiting silently and patiently for over 15 years for an end to this
painful episode in our lives.
McCarthy has had 2 trials. 2 judges and 24 jurors have unanimously found her
guilty of murder and sentenced her to death. When the judge handed down a death
sentence in 2002, the victim's family and loved ones considered it to be a
commitment to us by the state of Texas that justice would be served. So far,
that commitment has remained unfulfilled.
Judge Larry Mitchell has granted a stay of execution for McCarthy for 60 days.
There is no new evidence or DNA in this case. While lawyers and judges play
politics, our family and loved ones suffer the indescribable pain of loss that
no one should have to bear.
I call on Judge Larry Mitchell to stop prolonging our suffering and fulfill the
commitment that was made to us by the state of Texas.
