I suspect these files are created by the postinstall rather than included
in the .deb

I am not 100% sure whether this makes it a bug or not but I wanted to make
sure.

The empty directories below /usr/local are created by the emacs21-common
postinst script.  This is done on purpose and not a bug, see Policy ยง9.1.2.
