There is no hard dependency from the kernel on flash-kernel because it is platform specific whether flash-kernel is necessary. We've recently been discussing adding a Suggests, I've not thought about how versioned Suggests would work. A versioned Breaks or Conflicts might be more appropriate for the situation. The worst case would be apt etc deciding to remove flash-kernel altogether, for example on a platform without this particular issue (i.e. where it would have worked fine).
