OK so were was I? (1) possibly this is a kernel bug (or a bug on some kernel modules). (2) is an upload really pending? (3) is it neater to leave the current code alone for 2.4 kernels and put the new code (from the patch attached to this bug) in an "if kernel version is 2.6" clause? Just some thoughts...
