thank you for the bug report. You are right, this patch was wrong (it was however there since ages...). I applied it to the git repository and will upload to unstable when a new version is ready.
Unfortunately the migration from unstable to testing is currently blocked for ds9 (by #799841), so it will need a bit of patience to get it there :-)
