I was able to reproduce this using version 8.20210128. It seems to be fixed in version 10.20220526.
I think this was fixed by commit 1cacfd1b199b1a9a093716e04afd7e5ef4bd26a5. While that commit was fixing problems caused by test suite parallization that happened well after this bug was filed, so cannot be the cause of the bug itself, the commit really fixes a deeper concurrency problem that could have also affected older versions of git-annex. -- see shy jo
