This looks to be the same basic problem as bug #334911, although you're
asking for a shorter timeout.  I think it's possible to handle both
cases in a sane way.  I am surprised that the init script doesn't do
this for you - there is a 30 second timeout while it waits for freshclam
to exit cleanly, and then it kills it with kill -9.  Can you send me
some output of what you see when you change runlevels, so I can make
sure the init script isn't malfunctioning as well as freshclam?
