I fear this is not fixed.

The mmdebstrap-based reproducer clearly shows that upgrading from
bookworm to sid (2.126) still looses files. As a result, I am reopening
the bug report.

You opted for a solution that differs from all three solutions that I
suggested. You use dpkg-maintscript-helper to convert the directory in
the debian-reference-$LANG packages. Note that man
dpkg-maintscript-helper says:

| the preinst checks if the directory exists, does not contain ...,
| pathnames owned by other packages, or ..., if not then it's left in
| place, ...

As a result, what practically happens is that the dir_to_symlink
conversion is not carried out when performed by dpkg-maintscript-helper
for debian-reference-$LANG as debian-reference-common may still install
files below.
