Just FYI, I had this problem as well. Despite what the error message says, the log file permissions were fine, but there was a clamd process still running in the background which was causing the problem. /etc/init.d/clamav-daemon stop didn't kill it, but once I killed it manually, I was able to start the upgraded daemon successfully.
