If the magic is incorrect, it should be fixed; if the problem is in the parser, it should be fixed. Is it Apache parsing the magic here? In that case, it's an Apache bug: /usr/share/file/mime.magic is *not* a file Apache should be looking at (and it will shortly disappear, as we're about to fold the MIME types into the main magic file upstream). /etc/magic is a public file that anything may parse; /usr/share/file/mime{,.magic} are not.
If on the other hand it's libmagic parsing the file, then the magic is wrong.
