The init script of the versions up to 2.2.3-4 had this problem. Maybe you have modified your init script and not upgraded it? Does /etc/init.d/apache.dpkg-dist exist? If not, and if you use mod_php, maybe you are running into #366124. Check with lsof if different programs hold the socket open when restart fails.
