Your patch is for a one shot document but does it guarantee that all other documents using hyperref and titletoc/sec work in the same way? If not, so please don't add patch tags randomly. Maybe it is not to fix, maybe yes, who can tell? The latest version 2.8 from TL2009 (to be released) exhibit the same problem. So well. Maybe someone forwards that, me not.
