Are you sure?

the 2.6.12-5.99 packages in
http://packages.vergenet.net/testing/linux-2.6/
should be complied with gcc-3

That indicates that the bug still hasn't been addressed upstream,
and probably that there are no patches floating around.
I would suggest contacting the upstream driver maintainer to see if they
have any ideas.
