No. "non-free by omission" doesnt exist, "no usage restrictions" is what
counts and obviously includes the right to modify+distribute it, else it
would be a usage restriction, d'oh. Compare also with the WTF licence, which
only says "do what the fuck you want with this software", which is a
perfectly fine+free software licence.
jsmin.php OTOH, if the licence still says as you said in this bugreport, is
clearly non-free.
