Among many other things, there's nothing to defend yet. No one has done anything other than file a lawsuit. If you don't understand why the US government wouldn't be jumping in (publicly, no less, appears to be your expectation!) in a private civil lawsuit that's only just been filed, and for which no facts are yet available, then *please* just stay out of it.
