I don't think that this is the case. Firstly, because it leaves a
practical loophole in the AGPL:

-Person A takes some software under the AGPL.
-Person A privately gives the new software to Person B under the AGPL.
-Person B publishes the new program without source, because they haven't
modified it

Considering the legal aspects, the rule for verbatim copies only applies
to distribution in source form. The 5 options for distributing object
form all require offering source in some way.
