Besides this clearly not being a firmware issue, ath5k doesn't use any to begin with, I'd be quite confident to call this a hardware issue. Based on my own experience with the very similar Acer Aspire One 110L (which uses an identical chassis), the rfkill slide switch is mechanically extremely fragile and misfires easily when looking at it (or slightly bumping the netbook anywhere). It may help to physically lock the rfkill switch in its ON-position, to prevent vibrations from triggering it accidentally.
