This is commonly refered to as the "ASP[1] loophole" not the "PHP loophole" for the obvious reasons that the former describes the actual problem, whereas the latter is just a language that isn't restricted to usage by ASPs. Search for affero and asp loophole from somewhere around 2003 on -legal if you want more information on why closing this loophole is probably not possible to do in a free manner.
