Linus 2.4 kernels have never had ext3. ac trees have had ext3 for some time, but it is still marked as experimental (the description anyway, you can enable it with having CONFIG_EXPERIMENTAL set). In other words, nobody ever guaranteed it won't break. Having said that, ext3 seems to work just fine for most people with 2.4.12.
