The case study is obviously Lavabit. The only debate is over whether the NSA could extend it's reach to other nations. Would you want to bet the future existence of your ISP business on that question?

Granted, Lavabit was the recipient of one of the NSA's draconian "national security letters," but it turns out an international criminal of the first rank was using their service.
