I wanted to package this really cool program two years ago already, but I couldn't. The problem is not that the files created by upstream are not properly licensed. He is willing (and allowed, legally) to license proper license them under a free license. The real problem is, that it the program needs a lot of 'template' stuff and includes from delphi which license these templates not only under non-free terms (non-commercial use only), it is even undistributable (distribution explicitly not allowed to third-parties without prior agreement with borland; and they are likely not to give this permission, because that is what their delphy commerical version for a few hundert dollars is for).
