This is still present in 12.10. I'm currently running the gnome classic desktop with compiz and 3 monitors, two of which are stacked vertically. THe lower of the two contains the gnome panel UI and maximized windows there are overlapped by the panel. this occurs whether I'm using the default window manager, or emerald.
