I can confirm this issue on my UX32VD running Ubuntu 13.04.

However I don't know how this issue could be solved. The BIOS tells us
the maximum brightness value accepted but the minimum accepted value is
always 0. The actual behaviour of the different brightness values is
decided by the hardware, that means we have no way of knowing whether 0
means backlight off or minimal backlight on a specific machine, unless
by maintaining a list of hardware that turns backlight off when
brightness is 0.
