Remember, OpenSolaris is designed to be freely redistributable by anyone,
so including them in OpenSolaris requires paying for a world-wide,
unlimited copy, freely sublicensable license, or basically getting
permission to be the last license the patent holders ever can sell,
because no one else would need to buy after that. One can only imagine
how many billions of dollars they could ask in exchange for giving up
all future license sales.
