Is this still an issue in Ubuntu 12.04?

Bug description:
  i have a hp mini 1030nr with wifi Broadcom Corporation BCM4312
  802.11b/g ( rev 01) using the module wl, ssb

  kernel version : 2.6.31-14-generic
  Ubuntu 9.10 remix 

  when i start the machine with the switch in off and put it in on and
  want scan for networks i give a msg saying that this is not support so
  i need restart it ( with the switch in on ) and the scan work fine and
  the networks is found
