This looks to be Fixed since xorg-edgers is now using fglrx 9.x, which doesn't need patched for kernel 3.5.x

The best way to test is to install the xorg edgers ppa: https://launchpad.net/~xorg-edgers/ Steps to reproduce: step 1) Install xorg edgers ppa on fresh install of system. step 2) update to latest software release, and reboot. ( At this step everything for xorg/mesa will be usable) step 3) install fglrx. ( this will fail, due to dkms problems ) step 4) reboot.
