You are right: you can't ship your product with this without paying Sleepycat a fee.So either their lawyers find a way to argument THEIR interpretation that does not allow this or the license will be changed in some near/far future. Back to the jisp story.
But if it's your product that fetches it from the internet upon installation you don't have to pay anything.
