A few thoughts:

- this is a problem we need to fix, but it doesn't seem to be a regression from 
1.3.1, so I'd be in favor not to block that release.

- is anybody able to reproduce this?

- can we please have the full information from JUnit (from 
jackrabbit-core/target/surefire-reports/*.txt)?
