That is an edge case where the filter root node is not contained (in any
serialisation format) in the package. In that case it is deleted irrespective
of its import mode. That is a bug and should indeed be fixed. The workaround is
simple though: Never add filter roots with merge import modes on levels which
don't exist in the package.
