Because during assign phase the test will be if the node under test will pass the Rules for shard1 with port 8983 which *already* has exactly one node assigned. So it will never get there because to the beginning the number is 0 "zero". This is a logical error with "less than" and the Rules (first before assignment, second after assignment (verify)).
