OK: I committed a new test (TestMinShouldMatch2), it demonstrates the bug.... 
this currently passes on trunk but fails with the patch.

you can also run it many times with ant test -Dtestcase=TestMinShouldMatch2 
-Dtests.iters=100 and so on.

the test is not very thorough yet but its an improvement for now.
