Well, IANAL, but I think that this is not at all clear from how it is expressed there. They give a link to majority approval (where 3 binding votes are required), and then say:

"... except that the decision is officially determined solely by whether at least three +1 votes were registered."

I understand this 'except' to explicitly refer to the non-requirement of binding votes.

Anyway, it's not a big deal but maybe worth to clarify on the legal-discuss list?
