the poms will get changed automatically by maven in the release process (counting up the version). Maybe we have some formatting/linebreak issue which leads to dropping the comment...
For the release: What counts is the source-release.zip / tar.gz. We need to make sure that _all_ modules contained therein (even if not subsequently built by maven) must have the right license headers.
