[~jamestaylor], [^PHOENIX-4139_v2.patch] already has a kind of fix that makes 
the test case pass. I think it would be nice to include this fix.

But still we should keep a Jira ticket open because the internal behavior of 
the code is not as designed. I'm thinking of producing an error case but I did 
not yet find one. I'll clone this ticket in case you would commit my current 
fix and close. Then in the clone we can track the final solution.
