"TextMarker!" is a Firefox Plugin [3]. "Textmarker" appears to be a function in the German version of Microsoft Office [4]. I am by no means a legal expert, but it appears that the term has become commonplace in German and appears to be no longer protected (at least in the "pen" sector). A search on Google reveals that products by different vendors (e.g, Pelikan, Stabilo, Edding, etc.) are advertised as "Textmarker".
