While the pendantics do have a pendantic point, in practice the mere *cost* of demonstrating that you have standing should bring some reasonableness to any potential proceedings. And judges, as experienced lawyers, are often practical people -- claimants with trivial patches should, and are very likely to, get a fairly short hearing. Mores and community practice matter.
