---------- Forwarded message ---------- From: Internal Compliance Dept <[email protected]> Date: 9 August 2011 17:54 Subject: ICO Consultation - Privacy Impact Assessment on the Data Protection Register To: Internal Compliance Dept <[email protected]> ** ** ** ** ** *Public register of data controllers* ** ** I am writing to you following the ICO’s recent consultation on proposals to make the public data protection register available for reuse. **** ** ** The ICO is required by law to make the register available for inspection and currently does so via the ICO website. Following our consultation, we have now decided to make the register available in a machine readable, reusable format as well.**** The responses we received to our consultation played an important part in developing our approach in this area. The Privacy Impact Assessment Report is available online at http://www.ico.gov.uk/about_us/consultations/closed_consultations.aspx **** ** ** Work is now underway to make the register available for reuse. Further details are outlined below:**** ** ** ** ** *What is going to happen? * ** ** **· **The ICO will be making the public register of data controllers available for reuse in a machine readable format.**** ** ** ** ** *How will the register be made available? * * * **· **The register will be provided under the Open Government License and may be reused provided that the reuse of any personal data complies with the requirements of the Data Protection Act and, in particular, that such data are not used in a way that is inconsistent with the purpose for which the register was created, for example not used for direct marketing, or in a way that otherwise adversely affects the privacy of individuals. **** ** ** **· **Only information contained on the public register will be made available, and will be available in two forms. A short-form that includes the following fields of information: **** ** ** **§ **data controller name;**** **§ **data controller address;**** **§ **registration number;**** **§ **date of registration/expiry;**** **§ **freedom of information marker;**** **§ **voluntary registration (not part of registrable particulars); **** **§ **processing exempt data; and**** **§ **other names.**** ** ** And a long-form that also includes the purposes that the data controller is registered to process personal data.**** ** ** **· **Initially the register will be available for reuse on request and will be supplied on DVD in XML format. **** * * * * *Why has the ICO decided to make the register available for re-use? * * * **· **The ICO advocates transparency and openness.**** ** ** **· **It is a basic principle of data protection that the public should know (or should be able to find out) by whom their data is processed and for what purpose.**** ** ** Concerns raised during the consultation about the misuse of the information held on the register have been considered and are addressed by providing the register under the Open Government Licence and making it clear that reuse must comply with the Data Protection Act. For the avoidance of doubt, email addresses and telephone numbers do not form part of the public register.**** ** ** ** ** *When will the register be available?* ** ** **· **The register will be available on request from 22 August 2011. Requests should be sent to: [email protected] **** * * **· **We are also considering future plans to make the register available to download from the ICO’s website.**** * * * * For more information about notification, or the availability of the public register please visit the ICO website at: www.ico.gov.uk or call us on 0303 123 1113.**** ** ** ** ** ** ** Lesley Bett* *Head of Internal* *Compliance* * **** Information Commissioner’s Office, Wycliffe House, ******Water Lane******, Wilmslow, ******Cheshire****, **SK9 5AF****.**** T. 0303 123 1113 F. 01625 524510 www.ico.gov.uk**** ** ** ** ** ** ** ** ** ____________________________________________________________________ The ICO’s mission is to uphold information rights in the public interest, promoting openness by public bodies and data privacy for individuals.
